Article 1 — Purpose, Acceptance, and Acknowledgment

These Terms of Use (hereinafter "ToU") govern your access to and use of the mobile application « My Wine Cellar » (hereinafter the "Application"), published by Cédric Legrand.

The User and Cédric Legrand acknowledge that these ToU are concluded between the User and Cédric Legrand only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Cédric Legrand, and not Apple or Google, is solely responsible for the Application and its content.

These ToU may not contain usage rules that conflict with the Apple Media Services Terms and Conditions or the Google Play Store Terms of Service in effect. By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by all of these ToU. If you do not agree with these terms, you must not use the Application.

Article 2 — Legal Notice and Contact

The Application is published by Cédric Legrand. For any questions, claims, or complaints regarding the Application, the User must contact Cédric Legrand at the following contact details:

Article 3 — Access, Account, and Subscription

The Application is accessible to anyone with an internet connection. Some basic features are free, but full access to all features of the Application requires creating an account and subscribing to a paid plan (see Article 5). By creating an account, you agree to provide accurate, complete, and up-to-date information. You are solely responsible for the confidentiality of your login credentials and for all activities that occur under your account.

Article 4 — Scope of License

Cédric Legrand grants you a limited, non-transferable license to use the Application on any compatible device that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions and the Google Play Store Terms of Service. The Application may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

You may not:

  • (a) rent, lease, lend, sell, redistribute, or sublicense the Application;
  • (b) reverse-engineer, decompile, or disassemble the Application;
  • (c) copy, modify, or create derivative works of the Application;
  • (d) use the Application for any illegal or unauthorized purpose.

Article 5 — Premium Services and Subscriptions

5.1. Description

The Application offers advanced features ("Premium Services") accessible via a paid yearly subscription, at the price displayed by the App Store or Google Play Store. Monthly subscriptions already purchased remain valid and are managed by those platforms until they expire or are cancelled; they are no longer offered for purchase in the Application.

5.2. Subscription and Renewal

Subscriptions are managed exclusively through the application distribution platforms (Apple's App Store for iOS and the Google Play Store for Android). Outside a trial period, payment is charged to your App Store or Google Play account at the confirmation of purchase. During an eligible trial, no payment is charged at confirmation; the yearly subscription price is charged at the end of the trial, unless you cancel in the Store settings at least 24 hours before the trial ends. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.

5.3. Cancellation

You can manage and cancel your subscriptions at any time by going to your account settings on the App Store or Google Play Store. The cancellation will take effect at the end of the current subscription period.

5.4. Price Changes

Cédric Legrand reserves the right to modify the subscription prices. Any price change will apply to the next renewal period, subject to prior notice.

5.5. One-month trial

When this offer is available, a trial of the Premium Services lasting one (1) calendar month may be offered to eligible users. Eligibility is determined exclusively by the App Store or Google Play Store (in principle once per Apple ID or Google account). Premium access is immediate upon activation. At the end of the trial, the yearly subscription renews automatically, unless auto-renewal is turned off at least 24 hours before the trial ends in the Store settings. A reminder may be sent before conversion. The rules in sections 5.2 to 5.4 also apply to that conversion.

5.6. One-time reduced-price offer

When this offer is available, an introductory offer distinct from the trial may be presented once: the first subscription year is then billed at the reduced price displayed by the Store (around 50% off the yearly price), after which the subscription renews at the then-current yearly price. This offer cannot be combined with the one-month trial: the platforms in principle allow only one introductory offer per identifier and subscription group.

Article 6 — Maintenance and Support

Cédric Legrand is solely responsible for providing any maintenance and support services for the Application, as specified in these ToU, or as required under applicable law. The User and Cédric Legrand acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

Article 7 — Warranty

Cédric Legrand is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, the User may notify the purchasing platform (Apple or Google), which may refund the purchase price for the Application. To the maximum extent permitted by applicable law, neither Apple nor Google will have any other warranty obligation whatsoever with respect to the Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Cédric Legrand.

The Application is provided "as is". Cédric Legrand disclaims all warranties, including the implied warranties of merchantability or fitness for a particular purpose. The information provided by the Application, especially that from the label scanning feature, is for informational purposes only and is not guaranteed.

Article 8 — Claims and Limitation of Liability

The User and Cédric Legrand acknowledge that Cédric Legrand, and not Apple or Google, is responsible for addressing any claims of the User or any third party relating to the Application, including:

  • (i) product liability claims;
  • (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement;
  • (iii) and claims arising under consumer protection or privacy legislation.

The total liability of Cédric Legrand to you for all damages shall in no event exceed the total amount of subscription fees you have paid during the twelve (12) months prior to the claim.

Article 9 — User Obligations

You are solely responsible for the content you create in the Application. You agree to comply with applicable laws and not to infringe the rights of third parties. You are prohibited from using the Application to harass, abuse, threaten, or defame anyone.

Article 10 — Intellectual Property

The User and Cédric Legrand acknowledge that, in the event of any third-party claim that the Application or your use thereof infringes that third party's intellectual property rights, Cédric Legrand, and not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

All intellectual property rights in the Application belong exclusively to Cédric Legrand.

Article 11 — Consent to Use of Data

You agree that Cédric Legrand may collect and use technical data and related information to facilitate the provision of software updates, product support, and other services. This technical information may characterise your device; it is used for maintenance and support, and is not sold. Details are set out in the Privacy Policy.

The Application integrates third-party analytics and advertising measurement tools (Google Firebase Analytics and Meta Platforms SDK). These tools collect usage and behavioral data within the Application for the purpose of improving the service and measuring advertising performance. On iOS, your explicit consent is collected via the tracking authorization request (App Tracking Transparency) before any advertising tracking is enabled. On Android, advertising tracking is active by default, in accordance with platform standards.

Article 12 — External Services and Third-Party Terms

The Application may enable access to third-party services ("External Services"). You agree to use these services at your own risk. Cédric Legrand is not responsible for the content or accuracy of these services. You must also comply with applicable third-party terms of service when using the Application.

The Application notably integrates the following third-party services, whose terms of use and privacy policies apply to you:

Article 13 — Protection of Personal Data

The collection and processing of your data are governed by our Privacy Policy, which is an integral part of these ToU. To exercise your rights (access, a copy of your data, erasure, etc.), you may write to us at the address indicated in Article 2.

Article 14 — Legal Compliance

The User represents and warrants that they:

  • (i) are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
  • (ii) and are not listed on any U.S. Government list of prohibited or restricted parties.

Article 15 — Modification and Termination

Cédric Legrand reserves the right to modify these ToU at any time. The version in force is the one whose date appears at the top of the document, published in the Application and on the publisher's website. Your rights will terminate automatically if you fail to comply with any of its terms.

You may delete your account from the Application settings. Access is then revoked immediately. Identifying data and the content of your cellar are deleted or anonymised, in accordance with the Privacy Policy. Aggregated statistics that do not identify you may be retained.

Deleting your account in the Application does not cancel an ongoing subscription with the App Store or Google Play. If applicable, you must cancel it in the relevant store settings.

Article 16 — Governing Law and Jurisdiction

These ToU are governed by Belgian law. In the event of a dispute, exclusive jurisdiction is granted to the French-speaking courts of Brussels (Belgium).

Article 17 — Third-Party Beneficiary

The User and Cédric Legrand acknowledge and agree that Apple and Google, and their respective subsidiaries, are third-party beneficiaries of these ToU, and that, upon your acceptance of these ToU, Apple and Google will have the right to enforce them against you.

Article 18 — General Provisions

If any provision of these ToU is held to be unenforceable, the remaining provisions will remain in effect.
